We recommend that you contact us as soon as possible after you have decided to embark upon these transactions. We can then give you independent advice in connection with surveys and valuations, mortgages, deposits, life assurance, estate agents and a number of other features about which you will need to know.

We shall explain to you in outline the steps which will be involved, from the initial stages of obtaining the title deeds and preparing a draft contract on your sale, to completing the transaction on the date when you move into your new home. Thereafter, of course, we shall deal with all the necessary stamping of the purchase deed, registration of your title, giving notice of the transfer in the case of leasehold properties, dealing with the issue of a new share certificate where a management company is involved and generally ensuring that all the necessary procedures have been complied with on your behalf.

If after the transactions have been completed you need to take advice with regard to your obligations under any covenants which may affect the property, the buildings insurance, boundary rights and so on, we are available to assist you.

Purchase of a Freehold Property

Our costs cover all of the work required to complete the purchase of your new home, including dealing with Registration at the Land Registry and dealing with the payment of Stamp duty Land Tax (Stamp Duty) if the property is in England, or Land Transaction Tax (Land Tax) of the property you wish to buy is in Wales. 

Our costs are based on the total of three parts:-

Part 1 - Our Legal Fees

Our fees would be in the range of £1,750.00 plus VAT of £350.00 to £5,000.00 plus VAT of £1,000.00 (Total £2,100.00 to £6,000.00) depending on the factors that we have set out, however, if your proposed purchase is over £1 Million and up to £3 Million, please kindly contact us by telephone or email and we would be glad to advise you further and provide you with an estimate. 

Please Note:-

1.  If you are purchasing the property with the assistance of the 'Help to Buy Scheme', the figure of £80.00 plus VAT of £16.00 (Total £96.00) should be added to the figure quoted in our table of fees. 

2.  If you are purchasing a new build property, the figure of £250.00 plus VAT of £50.00 (Total £300.00) should be added to the figure quoted in our table of fees. 

3.  'Right to Buy' purchases - Our fees for where you are purchasing from the Council in relation to your eligibility as a tenant, we charge a fixed fee of £650.00 plus VAT of £130.00 (Total £780.00)

4.  'Shared Ownership' purchases - where you are purchasing a percentage of a property with a Social Housing Provider, £850.00 plus VAT £170.00 (Total £1,020.00)

5.  For purchases by Companies with a mortgage a fee of £350 plus VAT is to be charged in addition to the above listed fees. 

Part 2 - Disbursements 

Disbursements are costs related to your matter that are payable to third parties, such as Land Registry fees.  We handle the payment of the disbursements on your behalf to ensure a smoother process. 

This is the second part of our costs chargeable.  The following disbursements would be applicable to your purchase:-

a.   Search Pack comprising of Local, Mining, Environmental and Drainage Searches £217.50 + VAT of £43.50 - Total £261.00

b.   Land Registry Official Search - £3.00 per Title (for Registered Land). 

c.   Bankruptcy Search £2.00 per name (applicable if you are having a mortgage)

d.   Anti-Money Laundering Search Fee £4.17 + VAT of £0.83 - Total £5.00 per name

e.   Administration Charge for Bank Telegraphic Transfer fee £35.00 + VAT of £7.00 - Total £42.00 per payment.  This is required to send the purchase monies to the Sellers Solicitors to complete your purchase. 

f.    A fee is payable to the Land Registry to register the property in your name following completion.  The Land Registry fee is based on the value of your property.  Please refer to the following table for what would be charged on your particular matter:-

g.   A CREDAS Search for identification (if applicable) £6.67 + VAT of £1.83  (Total £8.00 per name)

h.   Lawyer Check Search (as may be required) £12.00 plus £2.40 VAT  (Total £14.40)

If your purchase is a Transfer of part of a Registered Title, for example if you are buying a new property from a builder, or the property has not been registered previously and an Application for First Registration of your Title needs to be submitted by post to the Land Registry, the following fees would be payable:-

Part 3 - Stamp Duty or Land Tax (on Purchase)

This depends on the purchase price of your property.  You can calculate the amount you need to pay by using HMRC's website or if the property is located in Wales by using the Welsh Revenue Authority's website here.  

This is the third part of our costs chargeable. 

Estimated Total Cost

 To obtain this, please refer to the figures and information given in Parts 1 'Our Legal Fees', Part 2 'Disbursements' and Part 3 'Stamp Duty or Land Tax (on Purchase)'.

Once you have obtained the figures from each section, you should add these together for an estimate.

How Long will my House Purchase Take? 

How long it will take from your offer being accepted until you can move in to your house will depend on a number of factors.  The average process takes between 8 to 10 weeks. 

It can be quicker or slower depending on the parties in the chain.  For example, if you are a first time buyer purchasing a new build property with a mortgage in principle, it could take twelve weeks if, of course, the property is build.  However, if you are buying a Leasehold property that requires an extension of the Lease, this can take significantly longer, between three and six months.  In such a situation additional charges would apply, and these timescales are only estimates and each transaction must be considered on its own facts. 

Stages of the Process 

The precise stages involved in the purchase of a residential property vary according to the circumstances.  However, the key stages in your purchase would include the following:-

-  Take your initial instructions. 

-  Check finances are in place to fund purchase and contact lenders Solicitors, if applicable

-  Receive and advise on contract documents 

-  Carry out searches

-  Obtain further planning documentation if required 

-  Make any necessary enquiries of seller's Solicitors 

-  Give you advice on all documents and information received 

-  Go through conditions of mortgage offer with you 

-  Meet with you or send you the Contract, Transfer Deed and Mortgage Deed (if applicable) for signature 

-  Agree completion date (Date from which you own the property) 

-  Exchange contracts and notify you that this has happened 

-  Arrange for all monies needed to be received from lender and you 

-  Complete purchase

-  Deal with payment of Stamp Duty/Land Tax

-  Deal with Application for Registration of your Title at Land Registry

Our costs assume that:-

a) This is a standard transaction and that no unforeseen matters arise including, for example, (but not limited to) a defect in Title which requires remedying prior to completion or the preparation of additional documents ancillary to the main transaction.

b) The transaction is concluded in a timely manner and no unforeseen complications arise. 

c) All parties to the transaction are cooperative and there is no unreasonable delay from third parties providing documentation;.

d) No Indemnity Policies are required.  Additional disbursements may apply if Indemnity Policies are required. 

 

Sale of a Freehold Property

Our fees for acting with any subsequent sale would be in accordance with the value of the property as set out in our Table of Fees. 

Part 2 - Disbursements

     Notice of Charge Fee (if the property is to be mortgaged) - This fee is set out in the Lease.  Often the fee is between £50.00 plus VAT of £10.00 (Total £60.00) to £200.00 plus VAT of £40.00 (Total £240.00)

     Deed of Covenant Fee - This fee is provided by the Management Company for the property and can be difficult to estimate.  Often it is between £100.00 plus VAT of £20.00 (Total £"120.00) to £250.00 plus VAT of £50.00 (Total £300)

     Certificate of Compliance fee - To be confirmed upon receipt of the Lease, as can range between £100.00 plus VAT of £20.00 (Total £120.00) to 250.00 plus VAT of £50.00 (Total £300.00)

     These fees vary from property to property and can, on occasion, be significantly more than the ranges given above.  We can give you an accurate figure once we have sight of your specific documents. 

     You should also be aware that Ground Rent and Service Charge are likely to apply throughout your ownership of the property.  We will confirm the Ground Rent and anticipated Service Charge as soon as we receive this information. 

h.   If the Title is unregistered, we would be required to do a search of the Index Map at the Land Registry.  The cost for this is £4.00. Furthermore, instead of Land Registry Official Search, we would do a Land Charges Search against relevant  estate owners at a cost of £2.00 per name. 

i.    A CREDAS Search (if applicable) - For Identification £6.67 + VAT £1.83 - Total £8.00 per name.

j.    Lawyer Check Search (as may be required) £12.00 plus £2.40 VAT (£14.40)

Part 3 - Stamp Duty or Land Tax (on Purchase) 

This depends on the purchase price of your property.  You can calculate the amount you need to pay by using HMRC's website or if the property is located in Wales by using the Welsh Revenue Authority's website.

This is the third part of our costs chargeable.

How Long will my House Purchase Take?

How long it will take from  your offer being accepted until you can move into your house will depend on a number of factors.  The average process takes between eight to ten weeks. 

It can be done quicker or slower, depending on the parties in the chain.  For example, if you are a First Time Buyer, purchasing a new build property with a mortgage in principle, it could take twelve weeks, if of course the property is built.  However, if you are buying a Leasehold property that requires an extension of the Lease, this can take significantly longer, between three and six months.  In such a situation, additional charges would apply and these timescales are only estimates and each transaction must be considered on its own facts. 

Stages of the Process 

The precise states involved in the purchase of a Residential Property vary according to the circumstances.  However, the key stages in your purchase might include the following:-

-  Take your initial instructions

-  Check finances are in place to fund purchase and contact lender's Solicitors, if applicable 

-  Receive and advise on contract documents 

-  Carry out searches 

-  Obtain further planning documentation if required 

-  Make any necessary enquiries of seller's Solicitors

This is the second part of our costs chargeable.  The following disbursements would be applicable to your sale:-

a.   Land Registry Title Information and Filed Plan - £6.00 per Title (for Registered Land). 

b.   Other Land Registry documents are £3.00 each (if required) 

c.   Anti-Money Laundering Search Fee £4.17 + VAT of £0.83 - Total £5.00 per name. 

d.   Administration Charge for Bank Telegraphic Transfer Fee £35.00 + VAT of £7.00 (Total £42.00 per payment).  This is required to send money to redeem any mortgagees secured on your property on Completion. 

e.   Leasehold Property Enquiry Form.  This is completed by the Managing Agents/Management Company/Resident's or Tenant's Association who manage the development for which your property forms part of.  Often the fee is between £150.00, plus VAT of £30.00, to £300.00 plus VAT of £50.00 (Total £180.00 to £350.00).  This fee varies from property to property an can, on occasions, be more than this range.  We can give you an accurate figure on being informed of the same.
